I'm in the midsts of a pretty terrible experience with a Long & Foster agent named Joseph Marinelli from their Wayne office. Joseph is the listing agent for a home I was scheduled to close on. However, his client removed certain appliances from the premises a week before settlement - including a refrigerator - which were contractually included as part of the terms of sale. When asked about them, Joseph immediately said he would replace the appliances with comparable ones, paying for it out of his own pocket. Joseph was combative about sourcing these appliances from reputable businesses, instead favoring Facebook Marketplace. When I arrived to the home for final walk-through the day of settlement, I was informed that the refrigerator Joe had installed *himself* leaked water overnight, severely warping the home's hardwood floors. Joe tried to hurry me through a solution in hopes of still closing that day, and I declined. Instead. Instead, I asked for his proposal in writing and told him that I would consider it. When he submitted an addendum to sale, the section where he should have included the details of how this would be rectified was completely blank. Now, Joseph's client is holding my deposit money hostage, despite clear breach of contract. While I recognize that the seller makes their own decisions, it is clear they are not entirely aware of the details of the situation - perhaps because it would hold Joe responsible. As the buyer, I was not offered an opportunity to agree to where the appliances were being sourced, and subsequently no opportunity to agree to who would be installing the appliances. It turns out that Joe installed the fridge himself, and obviously incorrectly, if it leaked all night. The realtor in this instance is 100% liable, and continuing to make poor decisions in an attempt to contain the situation. Red flag #1: If removing the original appliances was his client's error, why would Joe be paying for replacements with his own money? This suggests Joe miscommunicated to the seller that they could remove the appliances, putting him on the hook to fix the problem. Red flag #2: If the homeowner didn't select, purchase, or install the fridge, why/how is *their* insurance paying for it instead of Joe's insurance? Red flag #3: Joe made decisions about sourcing and installing the appliances independently, but doesn't want to be held responsible. The bottom line is, the home's condition was not maintained leading up to settlement, which is a clear breach of the agreement of sale. And Marinelli is responsible for it. The seller was expecting to close, and my agent was expecting to make a commission that day. But thanks to Joseph Marinelli's gross negligence, each party involved was disappointed.
